General Terms and Conditions

Before we can accept items for sale on ebay or our own web store, there are some basics that you and we need to agree and understand.

  • You will need to confirm that you are the legal owner of the item/s described on the inventory list and that there are no charges or debts on the said items which prevent you from entering into an arrangement to sell the item/s through this Agency Agreement with Auction-Bay.com.
  • You will need to agree to pay Auction-Bay.com a variable commission on the final sale price of your item/s (excluding postage and packaging) or £5.00 per item listing, whichever is the greater. This £5 minimum fee will not apply if you agree to list your item at an auction starting price of 99p and the item does not sell. In this case no fees whatsoever will be payable to Auction-bay.com.
  • Auction Bay.com agrees to list the item/s on eBay auction web site and or other auction sites or Auction-bay.com's own web store for sale and, in the event the item/s hasn’t sold, to relist the item/s for a second auction at no additional charge.
  • In the event that your item/s do not sell, the minimum administration charge of £5.00 per item will be payable before the item/s are returned to me, unless your auction was started at 99p in which case no fee is payable.
  • Should such item/s not be collected by you within 14 days of the close of the auction then Auction-bay.com may dispose of them at their discretion or donate them to their supported charity.
  • Additional charges for enhanced listings or variations to auction styles and collection or delivery charges may be payable by negotiation.
  • It is your express responsibility to supply all required information about the item/s and provide proof of address and identity and describe the item/s as thoroughly as possible including listing damage, defects and history.
  • All items to be listed for sale must be in a clean and saleable condition, and all clothing must have been washed or dry cleaned immediately prior to listing.
  • Fees for the sale of Reserve Price Auctions, Cars and Property vary from those described above and will be agreed on each individual item.
  • The sale of goods for registered charities and wholesale and job lots of surplus or redundant stocks will be agreed on an individual basis.
  • It is your responsibity to insure items for the entire period of this agreement up till the sale is completed and the buyer has paid for the item/s and that you will indemnify Auction-bay.com against any claims or circumstances made by third parties arising from the sale of your item/s.
  • Auction-bay.com agrees to accept the inventory listed item/s and to list them for sale in eBay Auctions in the auction format and price detailed for the agreed duration provided that the item/s comply with all eBay terms and conditions and Auction-bay.com may decline to accept items which do not meet these criterea.
  • Auction-bay.com will design, prepare and list items in appropriate categories in eBay Auctions with detailed descriptions and photographs and will respond to all buyer enquiries.
  • At the close of the auction, Auction-bay.com will liaise with the buyer and arrange packing and delivery of the items to the buyer. Postage and packing costs are listed separately in the auction and are payable by the buyer.
  • On completion of the sale and receipt of cleared funds from the buyer, Auction-bay.com will pay to the seller the proceeds of the sale, less the agreed commission and fees, by cheque to the confirmed address provided on the Inventory Form within 2-4 weeks of the end of the auction. This period allows for any returns made by the buyer or delivery to international destinations.
  • Auction-bay.com will issue a statement on completion of the sale to accompany the seller’s payment detailing all receipts and payments relating to the sale.
